Does the current ECJ decision mean the end of cookie tracking? The impact of the court decision on your marketing!

On October 1, the European Court of Justice passed a new judgement, which all marketing managers should be aware of. The following issues are affected by the ruling:

  • What consent do you need before setting a cookie or collecting PII data? 
  • Are cookies PII data?! What does this mean for the GDPR and the previous ePrivacy Regulation?
  • What information about the lifetime of the cookie and the connection of third parties is mandatory?

Two experts will inform you about these essential questions in this seminar:


Prof. Dr. Christoph Bauer, CEO of ePrivacy GmbH, explains the legal effects of the new jurisdiction and the current status after 1.5 years of GDPR:

  • ECJ judgements (Fashion ID and Planet49) and ePrivacy Regulation: what impact on data collection?
  • One year GDPR - Summary in 10 theses
  • Consent vs. Legitimate Interest
  • Explicit vs. Implicit Consent: what applies to which tracking?
  • (How) Can I continue to use Google solutions and Facebook buttons legally?
  • Where / on which servers should the marketing data be stored from a legal point of view and why?
  • Controller or processor? If providers claim data sovereignty for themselves, what are the legal consequences?
  • Privacy page on the company website: how do I design / update it? Is a regular manual update sufficient? Or in real time?


Subsequently, Christoph Bauer and Timo von Focht from Commanders Act will discuss the technical implementation of the legal provisions:

  • Differentiation of the CMP to a pure banner solution
